Grant of License

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Time of My Life App, LLC ("Company," "We," "Us," or "Our") regarding your use of the Time of My Life mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the App.

Licensor hereby grants to Licensee a non-exclusive, non-transferable, revocable license to use the Application solely for personal or organizational purposes, in accordance with the terms and conditions of this Agreement.

The Application may be installed and used on up to one (1) device owned or controlled by the Licensee.

License Restrictions

You agree not to:

• Modify, reverse-engineer, decompile, or disassemble the App.
• Rent, lease, lend, sell, sublicense, redistribute, or otherwise transfer the App.
• Use the App in any unlawful manner or for any unlawful purpose.
• Use the App in a way that interferes with its normal operation or with the use of the App by other users.

User Eligibility

The App is intended for individuals aged 4 years and older or individuals who have obtained consent from a legal guardian. Users with cognitive impairments are advised to use the App under supervision when necessary.

Child Privacy Policy

Time of My Life App is committed to protecting the privacy of children and providing a safe and secure experience for all users, including children with cognitive impairments. This Child Privacy Policy explains how we collect, use, and protect information from children under the age of 18 (or under the age of 16 in some jurisdictions) who use our app.

We collect only the minimal information necessary to provide and improve our services. The types of information we may collect include:

Health Disclaimer

No Medical Advice

The App provides tools, exercises, and information designed to support cognitive health and impairment management. However, it is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider regarding any medical condition or treatment. Reliance on any information provided by the App is solely at your own risk.

Individuals currently being treated for concussion or placed under brain rest by a physician for any reason, should not use this app without prior approval from their treating physician, or until they have been formally cleared from such restrictions.

No Guarantee of Results

The App's effectiveness in improving cognitive function or managing cognitive impairment varies by individual. Results are not guaranteed, and the App should not be used as a standalone treatment.

Use at Your Own Risk

By using the App, you acknowledge and agree that you are responsible for your use of the App and any outcomes that result. The developers and publishers of the App make no warranties or representations about its accuracy, completeness, or applicability to your needs.

User Responsibility

The App is not intended for use in emergency situations. If you experience a medical emergency, seek immediate assistance by contacting a healthcare provider or emergency services.

Ownership and Intellectual Property

Licensor's Rights: All intellectual property rights in and to the Application, including updates, enhancements, and accompanying documentation, are owned by the Licensor.

No Transfer of Rights: This Agreement does not transfer any ownership rights to the Licensee.

All rights, titles, and interest in the App, including but not limited to its content, features, and functionality, are owned by Time of My Life App, LLC or its licensors. This Agreement does not grant you any ownership rights.

Updates and Modifications

Time of My Life App, LLC may provide updates or modifications to the App. These updates may include bug fixes, feature enhancements, or new versions. You agree that these updates may be installed automatically and are subject to this Agreement.

Termination

This Agreement is effective until terminated by you or Time of My Life App, LLC. Time of My Life App, LLC may terminate this Agreement at any time without notice if you fail to comply with its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

Cancellation Policy

At Time of My Life App, LLC, we understand the unique needs of our users, including those living with cognitive impairments. Our goal is to ensure flexibility, fairness, and accessibility in our cancellation process.

Free Trial

• Users can cancel their subscription at any time during the free trial period without being charged.
• Notifications will remind users before the trial ends.

Paid Subscription

• Subscriptions can be canceled at any time through the app settings or the app store where the subscription was purchased.
• Access to premium features will remain active until the end of the current billing cycle.

Refunds

Refunds are available for unintended renewals or if the app does not meet expectations due to technical issues. Requests can be made via support@timeofmylifeapp.com.

Extended Cancellation Window

Users who face challenges due to cognitive impairment may request an extended cancellation or refund period by contacting support within 3 days of the renewal date.

Authorized Caregivers

Caregivers authorized by users can assist with subscription management. A simple verification process ensures the user's consent and privacy.

How to Cancel

• Via App Settings: Navigate to "Settings" > "Subscription" > "Cancel Subscription."
• Via App Store: Follow the cancellation process provided by your app store (e.g., Google Play, Apple App Store).
• Contact Support: Reach out to our support team at support@timeofmylifeapp.com or call us at 704.806.4880.

Notification Reminders

To prevent unintended charges, we provide notification reminders:

• 4 days before the trial ends.
• 4 days before subscription renewal.

Changes to the Policy

We may update this policy from time to time. Users will be notified of significant changes at least 30 days in advance.

Limitation of Liability

To the fullest extent permitted by law, Time of My Life App, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the App.

No Other Warranties: The Application is provided "AS IS" without additional warranties of any kind, including but not limited to warranties of merchantability or fitness for a particular purpose.

Maximum Liability: Licensor's total liability under this Agreement shall not exceed the amount paid by the Licensee for the Application.

Governing Law

This Agreement is governed by and construed in accordance with the laws of North Carolina. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in North Carolina.

Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements or understandings.

Amendments: Any modifications to this Agreement must be made in writing and signed by both parties.

Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Fees and Payment

The Licensee agrees to pay:

• A one-time fee of $99.99 annually
• Or a recurring fee of $34.99 per quarter
• Or $14.99 per month, as applicable
